Zurich instructs four top firms to defend $1bn insurance dispute from HSF client SBM

An armada of law firms has been drafted in to defend an energy insurance coverage dispute brought by Herbert Smith Freehills (HSF) client SBM Offshore.
The claim, issued against Zurich Insurance Group at the High Court on 14 July, is likely to become a $1bn dispute and one of the biggest cases of 2016.
HSF disputes partner and head of alternative dispute resolution Alex Oddy is leading for SBM, instructing Brick Court Chambers’ Mark Howard QC, Neil Calver QC and Stephen Midwinter.
Zurich has drafted in four law firms to defend the claim: Clyde & Co, Kennedys, Norton Rose Fulbright and RPC.
The claim relates to losses suffered following the termination of the YME MOPUster drilling platform in the Norwegian North Sea, which was scrapped in 2013 following an extended period of operational delays.
The platform had been evacuated in mid-2012 due to structural problems. The intricacies of the case will emerge when the multiple defences are filed in October.
Clyde & Co partner Tim Taylor has instructed 7KBW’s Christopher Butcher QC and Brick Court’s Tony Singla to defend a policy claim related to the primary insurance excess.
In the claim related to the first excess, Taylor has instructed 7KBW’s Jonathan Gaisman QC and Timothy Kenefick.
RPC partner Leigh Williams has been engaged in relation to the second excess, instructing 7KBW’s Dominic Kendrick QC and Ben Parker.
Kennedys partner Mike Wells is understood to have instructed Essex Court Chambers’ John Lockey QC.
Marine disputes partner Patrick Foss is understood to be leading for Norton Rose Fulbright, but his counsel team is not yet known.
